How will long COVID and vaccine side effects impact the employers’ daily expectations of employees related to business operations?

Employees experiencing the following conditions could result in impacting their performance and accessibility to benefits.

  • inability to finish assignments
  • anxiety
  • lack of focus on daily tasks
  • missed days of work to care for a family member illness due to vaccination or long COVID

Employer and employee awareness of long COVID and vaccine disabilities.

As of September 18, 2021, under certain circumstances, “long COVID” and vaccine injuries are a disability under the Americans with Disabilities Act (ADA) and Section 501 of the Rehabilitation Act. Therefore, employees should consult with their human resource department to ensure their performance and benefits are not impacted by any side effects. Disabilities insurance claims filed by employees who voluntarily got vaccinated to remain in the workforce or claim under long COVID will deal with ineligibility issues for short-term and long-term disability policies. There are also workman’s compensation issues and state and federal laws that must be reviewed.

Employers concerned about former employees who quit or were fired because of the organization’s vaccine policy will be relieved that the federal government has built a safety net that includes applying for Medicare and disability under Social Security. Americans can also file damages under the Countermeasures Injury Compensation Program (CICP) one year after the original vaccination date. However, it’s expected that most people that file for damages under CICP do not qualify. It is unknown if booster shots apply.

Employees and organizations can be assured that their insurance coverage currently falls under price protections of the Health Insurance Portability and Accountability Act, Affordable Care Act, and many state and other federal laws that protect prices based on health factors. However, rules can quickly change. An example of current legal insurance reduction costs offered to lower premiums is wellness incentives to vaccinated employees. But with President Biden’s mandatory vaccine program placed on businesses and government agencies, which makes employees take the vaccine voluntarily, creates unknown dynamics for employee benefits programs and costs, which will create an environment for employers and employees to continue to file lawsuits against insurance companies based on discrimination, pricing, and other coverage issues.

Unfortunately, there are no concrete answers for insurance companies, employers, nor employees and very few conversations on employee wellness and disabilities from long COVID and vaccines. All parties involved will be entangled for many years to come. Good Luck Everyone!

  1. Interesting article Dr. Lang, thank you for sharing. The worst part is the weaponization of fear. Both Covid and vaccines alike have been exploited by the media and their grubby business partners in D.C. It’s disgusting how they exacerbate hysteria and spin the needle of confusion. Now they push their anxiety into the workplace and make demands on people who are simply trying to grasp the truth. Evidently there is a vast fortune to be milked out this cow. Everyone must take their fair share… big government, big pharma, big tech, mainstream media… because suffering and misery equals financial gain for the elitist machinery. Yes, there are many long-term ramifications from both Covid and potentially from vaccines. It depends on the person and circumstances, case by case, but people on both sides (red and blue) are fed up with the lies, lecturing and innuendo. They are now manufacturing an agenda that suggests unvaccinated people are dangerous… that they should be stigmatized for their personal beliefs. So be it. The game is dirty, but let’s not forget it was the esteemed scientist who created a killer virus in a lab and unleashed it upon society… and then lied about it. Whether intentional or accidental, the global impact has been devastating.

    It’s a terrible notion that we are throwing unvaccinated people under the bus while scores of illegal immigrants stream across our southern borders without being checked for Covid. The hypocrisy and ignorance is breathtaking. Our incompetent government is far more dangerous than the disease itself. Lest we forget that Dr. Anthony Fauci himself was behind the funding and research of Covid-related diseases in Wuhan, yet that will not stop him from cashing in on his latest book tour. Voters should be outraged. Our government and world health experts need to stop censoring the truth. Perhaps they believe we are all stupid sheep, but they are mistaken… a medical degree does not give one license to assume the role of God. Research and development of this twisted nature needs to end. Period. There must be a reckoning. The better half of the scientific community needs to speak up and demand accountability. People can and should decide for themselves what is best for their body, not some bloated bureaucratic entity. As well, there must be an international outcry demanding an end to such Frankenstein research. That is the bitter truth, conflated statistics be damned. Respectfully…

  2. Great article, though have we considered what side-effects are produced by a diminished immune as wells as mental capacity? Stress-related dis-ease is perhaps an un-diagnosed aspect that surfaces in most, if not all, the symptoms you relate above. These are not COVID-related, though they are caused by the thoughtmospheric conditions we face today. The unprepared or unaware are even more impacted by the fear-laden narratives the world is getting pummeled by, imho.
