ONE OF THE four federal appeals courts reviewing similar suits has released it’s ruling. That ruling states that the ACA policies issued in the 34 states without a state market place, where policies were issued under the federal plan can not use federal subsidies to offset part or all of the premiums.
In effect this totally guts the ACA and means that some 8 million plus that bought policies based on a federal subsidy will now have to pay the full premium. The ruling also negates most of the requirement that smaller companies must provide insurance or pay a penalty/tax.
Of course the ruling will certainly go to the supreme court, but if upheld it basically spells a death knoll for the ACA.
